You win one as you lose the same one

Considering the end of civilization we’re in, this is close to a win, but I call it a loss.

The above story is a Puff-Ho link, sorry, but it’s to totally not-a-leftist libertarian Radley Balko who left Reason for the totally non-leftist Puff-Hos.

This exact scenario is my worst nightmare.

There’s this guy, Cory Maye, who was the recipient of a mistaken no-knock raid. He said he didn’t realize they were cops so he defended himself and killed one of the home invaders. Unfortunately, the cops were at the wrong house and the wrong guy killed the wrong guy. They did find a roach, of the marijuana type, so they had that going for them.

He says they didn’t announce, they say they did. Who knows? The fucking guy was asleep and all of a sudden there’s armed men in his house. Maybe they yelled “Cops” and he only woke up hearing a noise and defended his family. The way Americans are supposed to.

The poor guy’s been in jail for 10 years. Check that, he’s been on death row for 10 years. Because a bunch of armed thugs invaded the wrong house.

His lawyers finally got the courts to look at least close to reality and they let him out after 10 years.

He’s not “not guilty”, he’s guilty of something else and they’re letting him out with “time served”.

All this nightmare because the police invaded his home. No, because the police invaded the wrong home.

No-knock raids are a scourge on our country the way they’re used now.  They no-knocked a guy for kiddie pr0n. I’m not defending the guy, but do you really need a swat team for some pervert? Do you really need a no-knock raid for some random pothead?

There’s only one instance where a no-knock raid makes sense, for someone who’s especially violent. I would say the minimum requirement for a no-knock raid should be multiple violent, gun-related felonies, I could be convinced on a terrorist or a mob high-up, but definitely not for some random dope user or even dealer.

The  requirement must be “He’s a dangerous, murderous, vicious savage and we wouldn’t mind if we killed him in the raid”.

And if they break into the wrong house, you should be able to sue the shit out of them. As of right now, there is abso-fucking-lutely no repercussions for them mistakenly busting down your door and shooting your dog or you. “Sorry, your bad for being in a place where we felt the need to practice our Judge Dred routine”.

So even though the guy is being let loose after 10 years, justice most certainly has not been served. Balko has been all over this story, this link should be to his coverage over the last 10 years. It’s some infuriating reading.

We’re sliding farther and farther toward becoming subjects instead of citizens and it’s really pissing me off.

  2. I was thinking about this last night, and I wondered what my great grandfather would have thought about us being less free than his generation was.

    Whether its getting felt up to board an airplane, or having government in my light fixtures and in my toilet, we have all sorts of intrusions that great gramps would not have tolerated.
